1. Introduction and Acceptance of Terms

1.1. Welcome to the Cine & TV Artist Welfare Association (CTAWA) website, accessible at

 

(the “Website”). The Website is operated by CTAWA, a non-profit organization dedicated to the welfare of artists in the film and television industry.

1.2. These Terms of Use (“Terms”) govern your access to and use of the Website and all services, features, content, and applications offered by CTAWA (collectively, the “Services”). By accessing or using the Website or Services, you signify your agreement to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you may not access or use the Website or Services.

1.3. These Terms are governed by the laws of India, specifically within the jurisdiction of Maharashtra. CTAWA endeavors to comply with international data protection regulations, including but not limited to the General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), where applicable to the processing of personal data of individuals residing in those jurisdictions.

2. Eligibility and Membership

2.1. General Eligibility: To access certain Services, including applying for an Artist Card (ICM International Cinema Membership), or renewing membership, you must be at least 18 years of age or the age of majority in your jurisdiction, and legally capable of entering into a binding contract. By using the Services, you represent and warrant that you meet these eligibility requirements.

2.2. Artist Card Application:
A. To apply for an Artist Card, you must submit all required documentation, including proof of age, identity, address, and professional experience in the film and television industry, as specified on the “Apply Artist Card” page (

 

).
B. All submitted information and documentation must be authentic, accurate, and current. CTAWA reserves the right to verify the authenticity of any submitted data.

2.3. (ICM International Cinema Membership) Application:
A. Applications for an ICM International Cinema Membership require specific documentation related to international work engagements, as detailed on the “International Cinema Work Permit” page (

 

).
B. The ICM International Cinema Membership is non-transferable and is valid only for the individual and the specific project for which it was issued. Misuse or unauthorized transfer of an ICM International Cinema Membership will result in immediate revocation and potential legal action.

2.4. Membership Renewal:
A. Membership renewal is subject to the terms and conditions outlined on the “Renew Artist Card” page (

B. Continued membership requires adherence to CTAWA’s code of conduct and these Terms & Conditions.
C. If membership is not renewed within three (3) months of its expiration date, the membership will be automatically terminated.

2.5. Fraudulent Submissions: Any submission of false, misleading, or fraudulent information or documentation, whether for an Artist Card, ICM International Cinema Membership, or membership, will result in the immediate rejection of the application, termination of membership, and may lead to legal action. CTAWA reserves the right to permanently ban individuals involved in fraudulent activities from using its Services.

3. Services and Products

3.1. Artist Card & Membership Services: CTAWA provides services related to the application, processing, and renewal of Artist Cards and general membership. Members are expected to fulfill their obligations as outlined in the membership guidelines, including payment of fees and adherence to professional standards.

3.2. International Cinema Work Permit (ICM International Cinema Membership): CTAWA facilitates the application and verification process for ICM International Cinema Memberships. Users are responsible for understanding and complying with all international laws and regulations pertaining to their work permits.

3.3. Film India Directory:
A. The “Film India Directory” (

 

) contains copyrighted content. All content, including listings, images, and text, is the intellectual property of CTAWA or its licensors.
B. Reproduction, distribution, resale, or unauthorized use of any content from the Film India Directory is strictly prohibited.
C. Shipping and delivery of physical copies (if applicable) are subject to separate terms and conditions provided at the time of purchase.

3.4. Acting Classes:
A. Enrollment in “Acting Classes” (

 

) is subject to availability and payment of applicable fees.
B. All class materials, including recordings, lectures, and handouts, are the intellectual property of CTAWA or its instructors. Unauthorized recording, reproduction, or distribution of class content is prohibited.
C. CTAWA reserves the right to modify class schedules, instructors, or content at its discretion.

3.5. Members Directory:
A. The “Members Directory” (

 

) is provided for professional networking and legitimate industry-related purposes only.
B. Users are strictly prohibited from using the Members Directory for unsolicited commercial communications (spam), marketing, or any fraudulent activities.
C. Resale, redistribution, or unauthorized harvesting of data from the Members Directory is expressly forbidden. Violation of this clause will result in immediate and permanent ban from the Website and Services, and may lead to legal action.

4. Scam Alert Disclaimer

4.1. The “Scam Alert” page (

 

) is provided solely for informational purposes and to raise awareness about potential scams in the industry.

4.2. CTAWA is not liable for any losses, damages, or harm incurred as a result of third-party scams or fraudulent activities, even if such scams are listed or referenced on the Scam Alert page. Users are advised to exercise caution and conduct their own due diligence.

4.3. Individuals or entities listed on the Scam Alert page have the right to appeal their listing. To request removal, valid proof demonstrating the cessation of fraudulent activities or erroneous listing must be submitted to CTAWA for review. CTAWA reserves the right to make the final decision regarding removal.

5. Payments and Refunds

5.1. Artist Card, ICM International Cinema Membership, and Membership Fees: All fees paid for Artist Card applications, ICM International Cinema Membership applications, and membership (including renewals) are generally non-refundable. Refunds will only be issued in cases of:
A. Errors made by CTAWA in processing the application or membership.
B. Cancellation of the service by CTAWA before it has been rendered.

5.2. Film India Directory:
A. Purchases of the Film India Directory are refundable within one (1) hour of purchase, provided the content has not been accessed or downloaded.
B. Refunds will also be issued if the product is found to be defective or if a double charge occurred due to a technical error.

5.3. Acting Classes:
A. Application fees for Acting Classes are non-refundable.
B. Course fees for Acting Classes are non-refundable, except in the event that CTAWA cancels the entire course before its commencement. In such cases, a full refund of the course fee will be issued.
C. No refunds will be provided for missed classes, withdrawal from a course after it has started, or dissatisfaction with course content or instruction.

5.4. Event Cancellations:
A. If an event organized by CTAWA is cancelled by CTAWA, attendees will receive a full refund of their registration fees.
B. No refunds will be issued for no-shows or cancellations made by attendees.

6. User Conduct

6.1. Prohibited Activities: You agree not to use the Website or Services for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Website or interfere with any other party’s use and enjoyment of the Website. Prohibited activities include, but are not limited to:
A. Misusing the Website or Services, including attempting to gain unauthorized access to any part of the Website or Services.
B. Engaging in data scraping, data mining, or any similar data gathering and extraction methods.
C. Making fraudulent claims or submissions.
D. Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.

6.2. Directory Misuse: Any misuse of the Film India Directory or Members Directory, including but not limited to sending unsolicited commercial communications (spam), engaging in fraudulent schemes, or selling/redistributing data, will result in immediate and permanent ban from the Website and Services, and may lead to legal action, including claims for damages.

6.3. Intellectual Property: You agree to respect all intellectual property rights, including copyrights, trademarks, and trade secrets, belonging to CTAWA and its licensors. This includes, but is not limited to, CTAWA’s logos, website content, and the content within the Film India Directory and Acting Classes. Unauthorized use of any intellectual property is strictly prohibited.

7. Privacy and Data Use

7.1. Your privacy is important to us. Please refer to our Privacy Policy (

 

) for detailed information on how CTAWA collects, uses, stores, and protects your personal data. The Privacy Policy is an integral part of these Terms & Conditions.

7.2. By using the Website and Services, you acknowledge and agree that your personal data will be used only in accordance with our Privacy Policy.

8. Limitation of Liability

8.1. To the fullest extent permitted by applicable law, CTAWA, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:
A. Your access to or use of or inability to access or use the Website or Services.
B. Any conduct or content of any third party on the Website or Services.
C. Any fraud or misrepresentation by third parties, including those listed on the Scam Alert page.
D. Any misuse or unauthorized disclosure of member-shared data by other members or third parties.
E. Any content obtained from the Website or Services.
F. Unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

9. Termination of Services

9.1. CTAWA reserves the right, in its sole discretion, to suspend or terminate your access to the Website and Services, or any portion thereof, at any time and for any reason, including, without limitation, if you violate these Terms.

9.2. Upon termination, your right to use the Services will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

10. Dispute Resolution and Jurisdiction

10.1. These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions. You agree to submit to the exclusive jurisdiction of the courts located in Maharashtra, India, for the resolution of any disputes arising out of or relating to these Terms & Conditions or the Services.

10.2. Arbitration/Mediation: Before initiating any legal action, the parties agree to first attempt to resolve any dispute, claim, or controversy arising out of or relating to these Terms & condition or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, through good faith negotiation. If negotiation fails, the parties agree to consider non-binding mediation or binding arbitration in Maharashtra, India, in accordance with the rules of a mutually agreed-upon arbitration body.

11. Amendments to Terms

11.1. CTAWA reserves the right, at its sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days’ notice prior to any new terms & conditions taking effect. What constitutes a material change will be determined at our sole discretion.

11.2. By continuing to access or use our Website or Services after any revisions become effective, you agree to be bound by the revised terms & conditions. If you do not agree to the new terms & conditions, you are no longer authorized to use the Website and Services.

12 Miscellaneous

  • Severability: If any provision of these terms & conditions is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.
  • Entire Agreement: These terms & conditions should be read in conjunction with CTAWA’s Terms of Use and any other applicable service-specific policies or agreements.
